COPYRIGHT, FAIR USE, LICENSING

COPYRIGHT


Thank you for your interest in Felix Gonzalez-Torres and the Felix Gonzalez-Torres Family
Archive (the “Archive”). The Archive owns the copyrights to our materials. Any use of any of
our copyrighted materials not falling under fair use must be reviewed and approved by the
Archive (please see our Fair Use Policy below) under a license agreement provided by the
Archive. We review requests on a per case basis.

FAIR USE POLICY


In order to facilitate image use in art scholarship, the Archive takes the following stance on fair
use, licensing, and use of copyright-protected materials:


A. The Archive recognizes and supports reproductions of the Archive’s materials, for which
the Archive owns the copyright, based on the doctrine of fair use.
B. The Archive utilizes fair use in the Archive’s initiatives when reproducing Felix
Gonzalez-Torres-related materials, for which the Archive does not own the copyright.
C. Grants royalty–free or fee-based image use licenses to qualifying individuals and
institutions permitting reproduction of copyright-protected Archival materials in select
situations that (a) do not qualify as fair use or (b) the person/entity is not comfortable
publishing as fair use.


A. FAIR USE OF ARCHIVAL MATERIALS REPRODUCTIONS


The Archive recognizes and supports the use of images of Archival materials, for which the
Archive owns the copyright, under the doctrine of fair use with the goal of fostering scholarship,
disseminating knowledge, and enhancing educational initiatives. Possible uses include:

  1. Analytical, critical, interpretive, and/or creative writings/works
  2. Online (digitized) collections created for public scholarship
  3. Teaching including online coursework and study guides
  4. Articles and editorials in print and digital journals employing criticism, commentary
  5. Transformative use in artworks
  6. Personal or not-for-profit social media uses
    Publishing Archival materials under fair use does not require permission from or a license
    agreement with the Archive: however, all Archival materials must be properly cited in such
    manner that a reasonable viewer may easily associate the citation with the item, ideally on the
    same page or monitor screen. In order to ensure accuracy in color reproductions and citations,
    publishers are requested to contact the Archive to obtain authorized reproductions and citations.
    Any use shall not suggest that the Archive is sponsoring or is formally affiliated with the
    publisher.

This fair use policy does not include advertising, promotional, and commercial uses of the
Archive’s materials (unless previously granted by the Archive), nor does our fair use policy
apply to any uses not currently applicable under current fair use law. To request such uses, please

B. THE ARCHIVE’S POLICY ON USE OF COPYRIGHTED IMAGES


As a copyright holder, the Archive supports fair use of images of the Archive’s materials.
Similarly, as a creator of educational and scholarly content, the Archive exercises the right to
make fair use of copyright-protected content for which the Archive does not own the copyright.
If you have any questions or comments on our use of images or believe an image has been
reproduced in violation of copyright, please contact Mario M. Gonzalez.


C. LICENSES FOR IMAGE USE


For individuals and entities that are uncomfortable publishing under the doctrine of fair use or if
you do not think your intended use is protected by fair use, please contact Mario M. Gonzalez requesting permission to use the material(s).

Please include your and, if applicable, the institution/publication’s name, the number of images for which you are requesting permission, how the images will be used (e.g.- publication, print and/or digital,
academic use, etc.), and a brief description of your project so that we may evaluate your request
and understand the needs of your project. If available, please attach to your email a file of the
image or images that you are interested in. The Archive reserves the right to request further
information concerning your request.


Submissions will be handled in the order they are received. Please allow up to four weeks for
reply. Please note that incomplete submissions will not be reviewed.
